Please review these Terms of Service carefully before using MyPocketPlant.
By accessing or using MyPocketPlant ("we", "us", "our", or "the Service"), you agree to be legally bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any part of these terms, you must not use our Service. These Terms apply to all users, visitors, and adopters.
MyPocketPlant is open to users of all ages. However, since the Service requires a paid adoption, users must be able to complete transactions via Stripe Checkout. If you are a minor, you represent that you have obtained the consent of a parent or legal guardian to use the Service and enter into this agreement.
Monthly Billing: Services are billed on a monthly recurring basis via Stripe.
No Refunds: Due to the immediate allocation of resources, land space, and local farmer care required for your plant, all payments are non-refundable.
Lapsed Adoptions: If an adoption is cancelled or payment fails, the local farmer will continue to care for the plant until it reaches harvest or full growth as part of our commitment to the environment. However, daily photo updates and digital stat tracking will cease immediately upon the end of the paid period.
Local Farmer Care: "Adoption" refers to a service agreement where local farmers provide expert care for a specific plant. This does not constitute a transfer of land title or real estate ownership.
Seedling Growth: All adopted plants are grown from seedlings, not as fully grown plants as shown in shop images. Your plant starts small and grows alongside you over time. Shop images represent the mature state of the plant for reference purposes.
Update Frequency: We strive for daily photo and stat updates. However, you acknowledge that farming is subject to nature. Updates may be delayed due to emergencies or uncommon environmental conditions.
Data Collection: Data is collected daily. MyPocketPlant reserves the right to post "catch-up" updates (reporting previous days' data) or multiple updates in a single day when necessary.
Nature is unpredictable. If a plant dies or fails to thrive due to natural causes (such as pests, weather, or disease), we will provide a replacement seedling of the same tier at no extra cost. This policy is unlimited - we will continue to replace the plant to ensure your digital journey continues.
Digital Twins: Your plant’s digital representation is a database asset, not an NFT.
Tiers: Digital stats are determined by a plant’s assigned Tier (1 through 5), which is based on rarity and environmental factors.
Growth Link: Digital power is fueled by the real-world growth recorded by the farmers.
Your Photos: You are granted full rights to the daily photos provided of your plant. There are no copyright restrictions; you may share, print, or use these images as you wish.
Platform Content: All other software, logos, text, and game mechanics remain the property of MyPocketPlant.
User Choice: Upon harvest, you may choose to donate the produce to an NGO of your choice or allow the farmer to donate it to the local community.
Tax Disclaimers: MyPocketPlant is not currently able to issue tax-deductible receipts for these donations.
Shipping: Physical shipping of harvest is a "Coming Soon" feature. MyPocketPlant currently assumes no responsibility or liability for the logistics, safety, or delivery of physical produce.
Reporting: Users may report technical issues, seek guidance, or provide suggestions via our Report/Contact Us page.
Prohibited Conduct: You agree not to misuse the Service, including hacking, scraping, or harassing staff or farmers. We reserve the right to terminate accounts engaged in prohibited conduct without notice.
"As Is" Service: The Service is provided "as is." While we guarantee professional care for the plants, we cannot guarantee specific agricultural outcomes (e.g., specific plant height or yield).
Liability: To the fullest extent permitted by law, MyPocketPlant and its partners shall not be liable for any indirect or consequential damages resulting from your use of the Service or the natural failure of a plant.
These Terms are governed by and construed under the laws of the State of Delaware, USA. Any disputes shall be resolved through the courts located in Delaware.
